General Terms and Conditions

1. General conditions of validity

The website

is the property of DZJING BV. The seller DZJING BV is registered under VAT number BE0767509233. Each order is considered as acceptance of the terms and conditions by the buyer. These terms and conditions are an integral part of the agreement as described below.

2. Prices, offers and terms of payment

The prices of the products and services on the webshop shop.dzjing.be are indicated in euros, including VAT and excluding transport costs and / or other taxes or other levies, unless otherwise stated or agreed in writing.
Payment can be made by one of the methods indicated during the ordering process. Orders become effective only from the time payment is received by DZJING. In case of non-payment, DZJING reserves the right to suspend or dissolve (the performance of) the agreement regarding and related agreements. All offers are non-binding and DZJING reserves the right to change prices. If the products and services offered experience a price increase during the period between the placement of the order and its execution, the buyer has the right to cancel the order and rescind the agreement within seven (7) days from the announcement of the price increase by DZJING. The price indicated refers only to the items as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price. Invoices are payable at our registered office at Bronstraat 77/4, 2400 Mol, Belgium.
Any complaint regarding invoices, in order to be admissible, must be detailed by registered letter within three (3) days of receipt of the invoice.

Failure to take immediate action against a Buyer’s shortcoming may in no case be considered as a waiver on our part to invoke this shortcoming later.
DZJING accepts several payment methods through the Mollie platform.

3. Acceptance of the order

An order is not binding on DZJING until it is confirmed via email by DZJING or until execution of the order has begun. DZJING reserves the right to refuse orders or to attach certain conditions to the execution, unless explicitly stated otherwise. All product information, prices and ordering information are subject to possible changes and corrections at any time.

4. Delivery

The delivery times given by DZJING are indicative. The deadline for delivery is 30 days after receipt of the order. Exceeding a delivery time does not entitle the buyer to compensation, nor does it give the buyer the right to cancel the order or cancel the agreement, unless the delivery time has been exceeded in the sense that the buyer can no longer reasonably be expected to fulfill the agreement. In this case, the buyer has the right to cancel the order or, if necessary, cancel the contract. The buyer is liable for incorrect delivery due to an incorrect delivery address. In that case, additional charges may apply. In case of non-delivery, all amounts paid by the buyer will be reimbursed without interest or any other compensation. If you ordered a product that is not in stock, you will be notified. Once the products to be delivered are delivered to the specified delivery address, the risk, where these products are concerned, passes to the buyer.  Different conditions may apply to deliveries abroad. Deliveries are made in person, by Mail or by Courier service.  Delivery or shipping costs will be communicated to you before confirming your purchase. If shipping costs cannot be calculated automatically, this will be stated and/or an indication of shipping costs will be included.

5. Retention of title

The delivered goods remain the property of DZJING until full payment of the price, including all costs and charges, negligence interest and fees. In the event of non-payment, we reserve the right to take back the goods, by operation of law and at the Buyer’s expense.

6. Complaints

To be admissible, complaints must be directed to DZJING at info@DZJING.BE. If the delivery is not in accordance with the buyer’s order, complaints must be addressed within seven (7) days of the order. In case of hidden defects, within a period of seven (7) days after discovery of the defect. In this written communication, the buyer must describe the damage and provide proof of damage via photo.

7. Warranty

DZJING’s warranty is limited to the warranty for hidden defects and the consumer warranty act, both mentioned in the Belgian Civil Code. DZJING is liable for damages provided that they are a result of serious error or malicious intent. DZJING is not liable for general or specific indirect damages of any kind that may have been caused by the buyer.

8. Distance right – Returns

The Buyer may exercise the right of renunciation within fourteen days of delivery of the product or upon signature of a service agreement without penalty and without giving reasons. This can be done by notifying us in writing by e-mail at the address info@DZJING.be.  If the buyer invokes this right, the products must be returned in their original condition and packaging to DZJING, Bronstraat 77/4, 2400 Mol, Belgium at the buyer’s expense and risk. To ensure safe delivery of the package, we recommend using an insured courier service. The buyer is responsible for return shipping. The possibility of withdrawal does not apply in the case of delivery of goods manufactured according to the consumer’s specifications or of a clearly personal nature. Cash on delivery returns will not be accepted. Refunds will be made to the account number you provide upon receipt and review of the return. 

9. Force Majeure

DZJING cannot be held liable for possible delays in the performance or non-performance of its obligations caused by circumstances beyond DZJING’s control. Such circumstances include problems with the supply or lack of raw materials, interruption or permanent suspension of production, strikes, lockouts, any other form of business disruption or trade disputes, power outages or non-delivery or late delivery affecting DZJING and/or DZJING’s suppliers, even if these circumstances could be expected. If DZJING does not act immediately against a deficiency to the buyer, this can in no way be seen as neglect on the part of DZJING to cite this deficiency later.

10. Personal information

By submitting an order on the DZJING website, the buyer officially agrees to the processing of his or her personal data for administrative purposes, such as the management of customer records, orders, invoices and deliveries and the follow-up of financial solvency. Personal data will only be used for promotions, personalized advertising and/or other marketing-related purposes if the buyer explicitly agrees to it while placing an order. This can be changed by the buyer at any time. DZJING will not disclose personal information to third parties. The buyer has the right to view and change his or her personal information at any time. The buyer also has the right to oppose – free of charge – the processing of his or her personal data for Direct Marketing initiatives. For more information, the buyer may contact the Privacy Commission in Brussels.

11. Intellectual property 

Our website, logos, texts, photos, names and in general all of our communications are protected by intellectual property rights vested either in us, our suppliers or other rights holders. It is prohibited to use and/or modify the intellectual property rights described in this article. For example, you may not copy or reproduce drawings, photos names, texts, logos color combination, etc … without our prior and express written permission.
DZJING is a registered Benelux trademark.

12. Use of cookies 

Our website uses cookies that allow `cookies` to be placed on your computer’s hard drive during a visit to our site. A cookie is a text file placed by a website’s server in your computer’s browser or on your mobile device when you access a website. Cookies are used to optimize your visit. Cookies cannot be used to identify individuals; a cookie can only identify a machine.

You can set your Internet browser to not accept cookies, to alert you when a cookie is installed, or to delete cookies from your hard drive afterwards. You can do this through your browser’s settings (via the help function). Keep in mind that certain graphics may not appear correctly, or you will not be able to use certain applications.

13. Proof

The parties involved agree that a valid contract will be prepared using electronic means of communication.

14. Miscellaneous
Should one or more provisions of the agreement be declared null and void, this will in no way affect the validity of the other provisions. DZJING has the right to change the contents of these general terms and conditions. Changes will be announced via the website.

15. Applicable law

All agreements made with DZJING are subject to Belgian law. All disputes between the parties shall be submitted exclusively to the competent court in Belgium. The Buyer may exercise the right of renunciation within fourteen days of delivery of the product or upon signature of a service agreement without penalty and without giving reasons.
